Terms of Service

These Terms of Service ("Terms") form a binding legal agreement between you and Asaf Niv, an independent developer doing business as "Bayit" ("Bayit," "we," "our," or "us"), governing your use of the Bayit iOS app and bayitapp.com (together, the "Service").

By installing, accessing, or using the Service, you accept these Terms. If you do not accept them, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service (16 in the European Economic Area, or such other age as required by local law for individual consent to data processing). By using the Service, you represent that you meet this requirement and that any information you provide is accurate.

2. The service

Bayit is a daily Jewish learning companion offering:

  • An AI-powered chat assistant grounded in Torah sources.
  • A weekly parsha feature with thematic teachings.
  • A Tanakh reader with Hebrew and English alongside.
  • A daily plan with streaks and journey progression.
  • Shabbos times, reminders, and a home-screen widget.
  • Related features released from time to time.

Features may be added, modified, or removed at our discretion. We will provide reasonable notice of material adverse changes.

3. Your account

Bayit creates an anonymous account on first launch. You may subsequently upgrade to a Sign-in-with-Apple account, which lets your data sync across devices. You are responsible for maintaining the security of your Apple ID and the device(s) on which you use the Service. You may not impersonate another person or share an account.

4. Acceptable use

You agree not to, and not to permit any third party to:

  • Use the Service in violation of any law or regulation.
  • Use the chat for content that is illegal, hateful, threatening, defamatory, harassing, sexually explicit, exploitative of minors, or that promotes self-harm or violence.
  • Attempt to extract, jailbreak, prompt-inject, or otherwise manipulate the underlying AI model to produce harmful or policy-violating output, or to expose system instructions.
  • Use the Service to develop or train a competing product or AI model.
  • Scrape, reverse-engineer, decompile, or disassemble the Service except to the limited extent permitted by applicable law.
  • Interfere with or disrupt the Service, its servers, or networks connected to the Service.
  • Resell, redistribute, or sublicense the Service or any content obtained from it in a manner that competes with the Service.
  • Use the Service to send unsolicited messages, malware, or phishing attempts.

We may suspend or terminate accounts that violate this section, with or without notice.

5. Bayit's content and your content

5.1 Our content

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. The Bayit name, brand mark, app icon, painted illustrations, wordmark, design vocabulary, and the product code are owned by us or our licensors and protected by copyright, trademark, and other intellectual-property laws. You may not use them without our prior written permission.

Tanakh, Mishnah, Talmud, classical commentary, and related public texts are sourced from Sefaria, Inc. under their respective Creative Commons licenses (most CC-BY or CC-BY-NC). Attribution and license terms are preserved as required.

5.2 Your content

"Your Content" means any message, note, highlight, or other content you submit to the Service. You retain ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, transmit, reproduce, modify (only as necessary to provide the Service — e.g., generating embeddings for memory retrieval), and display Your Content solely for the purpose of operating and improving the Service. This license terminates when you delete Your Content or your account, subject to our legitimate retention obligations (see Privacy Policy).

You represent and warrant that Your Content does not infringe any third party's rights and complies with these Terms.

5.3 AI-generated responses

Responses generated by Bayit's chat ("Bayit Output") are produced by an AI model and may not always be accurate, complete, or current. Bayit Output is provided for educational and inspirational purposes only.

Bayit is not a Rav, posek, halachic authority, attorney, doctor, therapist, or licensed advisor. For halachic questions of practical consequence, consult a competent Rav. For medical, mental-health, legal, or financial questions, consult a qualified professional. Do not rely on Bayit Output as a substitute for personalized professional guidance. We accept no liability for decisions made in reliance on Bayit Output.

You may use Bayit Output for your personal study and reflection. You may not represent Bayit Output as a halachic ruling or as professional advice.

6. Subscriptions and billing

6.1 Auto-renewing subscriptions

Bayit may offer optional auto-renewing subscriptions ("Bayit Premium"). When you purchase a subscription:

  • Payment is charged to your Apple ID on confirmation of purchase.
  • Your subscription automatically renews at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period.
  • Renewal charges are billed within 24 hours prior to the end of the current period, at the published price unless we have notified you of a price change.
  • You can manage or cancel subscriptions at any time in your Apple ID settings (iOS Settings → your name → Subscriptions). Uninstalling the Bayit app alone does NOT cancel a subscription.
  • Cancellations take effect at the end of the current billing period. You retain access to paid features until then. No partial refunds are issued for unused time except where required by law.

6.2 Free trials and promotional pricing

If we offer a free trial, you must cancel before the end of the trial to avoid being charged. Any unused portion of a free trial is forfeited when you purchase a subscription. Promotional pricing is one-time per Apple ID unless we state otherwise.

6.3 Refunds

Apple processes all App Store payments and handles refund requests. Refunds are governed by Apple's policies. To request a refund, visit reportaproblem.apple.com. We do not have the ability to issue App Store refunds directly.

6.4 Price changes

We may change subscription prices going forward. We will notify you of any price increase before it applies to your renewal, and you may cancel before it takes effect.

7. Termination

You may stop using the Service at any time. To delete your account, open Bayit → Settings → Delete Account, or follow the instructions on our Account Deletion page. Cancelling a subscription must be done separately in your Apple ID settings.

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, posed a security or legal risk, or for any other reason permitted by law. On termination, Sections 5 (IP), 8 (Indemnification), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Dispute Resolution), 12 (Governing Law), and 13 (General) survive.

8. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Bayit, its developer, and any affiliates and service providers (collectively, the "Indemnified Parties") from any third-party claim, liability, loss, demand, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to: (a) Your Content; (b) your use or misuse of the Service; (c) your violation of these Terms; (d) your violation of any law or third-party right. We may, at our option, assume the exclusive defense of any claim subject to indemnification, and you agree to cooperate fully in such defense.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL CODE; THAT BAYIT OUTPUT WILL BE ACCURATE OR HALACHICALLY AUTHORITATIVE; OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE INDEMNIFIED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

OUR AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In those jurisdictions, the exclusions and limitations in this section apply to the maximum extent permitted by law.

11. Dispute resolution

11.1 Informal resolution

Before bringing a formal claim, you agree to first contact us at legal@bayitapp.com with a description of your concern. We'll work in good faith to resolve it within 30 days.

11.2 Class-action waiver

To the extent permitted by law, you and Bayit agree that any dispute will be resolved on an individual basis only and not as a class action, collective action, or representative proceeding. You and Bayit waive the right to a jury trial in any such dispute to the extent permitted by law.

12. Governing law and jurisdiction

These Terms are governed by the laws of the State of Israel, without regard to its conflict-of-law principles. The courts of Tel Aviv-Jaffa, Israel, have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service, and you irrevocably consent to that jurisdiction and venue — except where applicable consumer-protection law in your country of residence grants you the right to bring proceedings in your local courts, in which case that right is preserved.

13. DMCA and copyright

We respect the intellectual-property rights of others. If you believe that material accessible on or from the Service infringes your copyright, please send a notice to dmca@bayitapp.com containing:

  • Your physical or electronic signature.
  • Identification of the copyrighted work claimed to be infringed.
  • Identification of the material that is claimed to be infringing and where it is located on the Service.
  • Your address, telephone number, and email address.
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We will respond to valid notices in accordance with the Digital Millennium Copyright Act and may remove or disable access to the allegedly infringing material. Repeat infringers' accounts will be terminated.

14. Apple-required terms

Because Bayit is distributed via the Apple App Store, you acknowledge and agree that:

  • These Terms are between you and Bayit, not with Apple. Apple is not responsible for the Service or its content.
  • Apple has no obligation to provide maintenance or support for the Service.
  • In the event the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
  • Apple is not responsible for addressing any product-liability, consumer-protection, or intellectual-property claim related to the Service.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, with the right to enforce them against you.
  • You represent that (i) you are not located in a country subject to a U.S. government embargo, or designated as a "terrorist supporting" country, and (ii) you are not on any U.S. government list of prohibited or restricted parties.

15. Beta features and early access

We may, from time to time, offer beta or experimental features. These are provided AS IS, may be discontinued at any time, may contain bugs, and are not subject to any service-level commitment.

16. Notices

Legal notices to Bayit must be sent in writing to legal@bayitapp.com. We may give you notice by email (to the address associated with your account, if any), in-app notification, or by posting an update on bayitapp.com.

17. Changes to these Terms

We may update these Terms from time to time. We'll update the "Last updated" date at the top, and for material changes, we will provide reasonable advance notice in-app and/or by email where we have one. Your continued use of the Service after the change takes effect means you accept the updated Terms. If you do not accept, you must stop using the Service before the change takes effect.

18. General

  • Entire agreement. These Terms and the documents they reference (Privacy Policy, Cookie Policy, Account Deletion page) constitute the entire agreement between you and Bayit regarding the Service and supersede any prior agreement.
  • Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
  • No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms or any rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
  • Force majeure. We are not liable for failure or delay caused by events outside our reasonable control, including acts of God, war, terrorism, civil unrest, government orders, pandemics, internet outages, or infrastructure failures.
  • Independent contractors. Nothing in these Terms creates an agency, partnership, joint venture, or employer-employee relationship.
  • Headings. Section headings are for convenience only and do not affect interpretation.
